License agreement for ANET.at HomepageSearchEngine ================================================== (last updated on 2006-09-06) By ordering, downloading or installing our software called "HomepageSearchEngine" (here called "the software") you must agree to the most recent version of the following terms and conditions, always available on our website at http://www.HomepageSearchEngine.com/_download/license.txt All rights not expressly granted belonging to the software are reserved to the company "ANET" Allerstorfer & Beutel OEG, 1020 Wien, Franz-Hochedlinger-Gasse 5/1 (Austria) (here called "ANET.at"), represented by Ing. Robert Allerstorfer (the software's author) ____________________________________________________________________________ 1. Disclaimer The software is distributed "AS IS" and without any other warranties as mentioned below. ANET.at cannot be made responsible for any loss of data or any other problems (such as performance issues or abuse). Any liability of the seller will be limited exclusively to product replacement or refund of purchase price. ____________________________________________________________________________ 2. General agreement to use the software All program packages available from our website (www.HomepageSearchEngine.com) or from other distribution channels such as shareware/freeware collections may be installed and used on any website. The Executable's source code must not be reverse engineered, nor may the Executable be modified in any way. If the software is used in "Trial mode" (that is without an additional available key), it may only be used for evaluation purposes and not longer than for 30 days. ____________________________________________________________________________ 3. Agreement to use "HomepageSearchEngine Free" If the software is used with the additional available "Free key", it operates as freeware version, called "HomepageSearchEngine Free". That version may be used by everybody for free. An unlimited number of installations is allowed on all sites. Redistribution is also allowed, as long as the original packages keep unchanged and no fee is charged. Using it implies accepting its limitations, including displaying of the HomepageSearchEngine Logo. The "Free key" may be downloaded from our website at http://www.HomepageSearchEngine.com/_download/key_HSE-Free.zip ____________________________________________________________________________ 4. Agreement to use a registered version of the software If the software is used with a purchased license key, it operates as full version, either as the so called "Plus" or "Pro" edition. The license holder must take care to avoid access to the license key by unauthorized persons! Especially, it is strictly prohibited to distribute a license key. When the license key has been applied to a downloaded package, the "Trial" message disappears, but there will still be printed a small "label" at the bottom of the results pages, stating the software name and version, like "HomepageSearchEngine Pro/Plus x.xx (c) 2006, ANET". Purchasing a standard license implies the agreement to display that label. Removing the label is only possible with a special so called "unlabeled" key which is available for the Pro edition on request, for an additional fee. ANET.at may also issue it without charging an additional fee, but there is no warrantee to do so. Depending under which license model a key has been purchased, there are different permissions for which websites a key may be used for: 4.1 Site license ---------------- The key allows an unlimited number of installations under one certain site. It is bound to the licensed site (a website of the Inter- or Intranet), identified by its ServerName or HTTP-Host (domain name or IP address based), such as 'mysite.tld' (which includes 'www.mysite.tld' as well), or - if IP based - '192.168.0.1'. If the site is hosted on multiple machines (for instance, to split network traffic), the key is valid on all these machines, as long as the site can be reached via the same URL. 4.2 Wildcard Site license ------------------------- The key allows an unlimited number of installations under one certain site and all its sub domains, such as '*.mysite.tld', including 'www2.mysite.tld', 'intranet.mysite.tld' and so on. 4.3 Host license ---------------- The key allows an unlimited number of installations on one server machine, for all sites hosted on that machine. It is bound to the licensed machine, identified by its hostname. 4.4 Enterprise license ---------------------- The key allows an unlimited number of installations on all sites attended by the license holder. ____________________________________________________________________________ 5. Warranty ANET.at warrants that the software will work on all supported systems as stated in the Manual found within the program package and on our website, otherwise the purchase price will be refunded. Once a license key has been received it is not possible to refund the purchase price unless it does not work as stated above.
